HIVE FIT CLUB MEMBERSHIP TERMS OF SERVICE
Effective Date: July 2025

Thank you for choosing Hive Fit Club as your premier fitness and wellness destination. These Membership Terms of Service (“Terms”) apply to all memberships, guest passes, and use of Hive Fit Club’s services and facilities. By accessing or using any of our services, you agree to comply with these Terms as well as all additional policies referenced herein.

Note: All members and guests are required to sign a separate Liability Waiver Agreement before using the facilities.

1. Membership Terms and Conditions

A. Membership Options
Types of Memberships:

  • Monthly Membership: Billed monthly with ongoing access to facilities and select services.

  • Annual Membership: Billed annually with a discounted rate compared to monthly plans.

B. Terms, Renewal, and Amendments

  • Start Date & Renewal: Your membership begins on the date of registration and will automatically renew at the end of each billing cycle (monthly or annually) unless cancelled in accordance with our Cancellation Policy.

  • Amendments: Hive Fit Club reserves the right to modify these Terms at any time. Changes will be communicated via email and/or posted on our website at least 30 days prior to taking effect. Continued use of the services after the notice constitutes acceptance of the revised Terms.

2. Payment Policies

A. Billing Cycle and Methods

  • Billing Cycle: Membership fees are billed on a monthly or annual basis, according to the membership option selected.

  • Accepted Payment Methods: We accept major credit cards, debit cards, and direct debit payments as provided during registration.

  • Card on File for Recurring Billing: By signing these terms, you agree to allow Hive to keep your credit card on file for purposes of house accounts and recurring billing.

B. Non-Payment

  • Consequences: Repeated missed payments may result in temporary suspension or termination of membership privileges until the account is brought current.

C. Refunds
Refund Policy: Refunds or credits will be issued only under the following circumstances:

  • In cases of overpayment or billing error, a pro-rated refund may be issued at the discretion of Hive Fit Club management.

  • Note: Once services have been rendered during a billing period, fees are generally non-refundable.

3. Cancellation and Termination Policy

A. Member-Initiated Cancellations

  • Cancellation Process: Members may cancel their membership by providing a written 30-day notice.

  • Cancellation Effective Immediately: Once a member gives cancellation notice, the membership ends immediately. It does not continue until the end of the billing cycle. For this reason, we advise members to cancel at the end of their current month billing cycle.

  • Billing During Notice: All scheduled billing during the notice period remains due.

  • Re-enrollment: If you cancel and later re-enroll, the standard $99 Hive Improvement Fee will apply, and you will be subject to the current membership rates.

B. Club-Initiated Termination

  • Termination by Hive Fit Club: We reserve the right to terminate any membership at our sole discretion, with or without cause, and for any reason whatsoever, including but not limited to the following:

  • Violation of club policies or the code of conduct

  • Non-payment or repeated late payments

  • Behavior that endangers the safety or comfort of other members or staff

  • Hive Fit Club is under no obligation to provide advance warning or explanation for termination.

  • Refunds on Termination: In cases of club-initiated termination, refunds (if any) will be processed on a prorated basis at the discretion of management.

4. Code of Conduct and Facility Use

A. Behavioral Expectations

  • Members must treat fellow members, guests, and staff with respect and courtesy. Any abusive or disruptive behavior may result in termination of membership without refund.

B. Equipment and Facility Use

  • Proper Use: Use equipment only for its intended purpose and follow all posted instructions.

  • Dress Code:

  1. Proper gym clothing is required

  2. No pajamas, sandals, crocs, slippers, or flip flops

  3. Swim suits required for cold plunge and saunas

  4. No sports bras, underwear, or gym attire in the cold plunge

  • Personal Belongings: Members are responsible for securing their personal belongings. Hive Fit Club is not liable for lost, stolen, or damaged items.

C. Hygiene and Cleanliness

  • Members are expected to clean and return equipment after use and adhere to all posted hygiene protocols.

D. Gym Etiquette Rules

  1. Re-rack our weights – Don’t be that person.

  2. Wipe off equipment after each use – Wipe stations are provided throughout the facility.

  3. No food or drinks in the gym unless in a closed container – Peak performance requires clean conditions.

  4. No bags on the gym floor – Use lockers or cubbies.

  5. Shirts on at all times – That’s what the posing room is for.

  6. Cameras & filming – $50 filming day pass required. Executive and Premier members may film with 48-hour advance written approval (email: info@hivefitclub.com).

5. Health and Safety Policies

A. Risk Acknowledgment
Assumption of Risk: By participating in fitness activities, you acknowledge that exercise carries inherent risks, including injury. You affirm that you are in good physical condition and have obtained any necessary medical clearances.

B. Emergency Procedures
In Case of Emergency: Follow the instructions provided by Hive Fit Club staff and adhere to posted emergency procedures, including the location of first aid kits and emergency exits.
Contact Procedures: In an emergency, immediately contact a staff member or use the designated emergency contact system.

C. Health Requirements
Members are responsible for consulting with their physicians regarding participation in fitness programs, particularly if you have pre-existing health conditions.

6. Waiver and Release of Liability

  • Liability Waiver: Prior to using our facilities, all members and guests must sign a separate Liability Waiver Agreement. This waiver acknowledges the risks associated with physical activities and releases Hive Fit Club, its owners, employees, and agents from liability for any injuries sustained.

  • Medical Clearance: Members are responsible for seeking medical advice if they have any health concerns prior to participation.

7. Privacy Policy

8. Personal Training and Class Policies

A. Scheduling and Booking
Booking Procedures: Members can schedule personal training sessions and classes via our online portal or at the front desk.

B. Cancellation Notice
Cancellations for personal training must be made at least 12 hours in advance; class cancellations require at least 4 hours notice. Fees apply to cancellations made without required advance notice.

C. Additional Fees
Specialized services may incur additional charges, which will be communicated prior to booking.

D. Attendance and No-Show Policies
A fee of $10 will be charged for no-shows or late cancellations (less than 4 hours for classes or 12 hours for appointments). Non-members may incur higher fees or loss-of-service credits.

9. Guest and Visitor Policies

A. Guest Access
Conditions: Guests can access by purchasing a one day or multi-day guest pass.

B. Guest Behavior
Guests are required to adhere to all Hive Fit Club policies, including the code of conduct and facility guidelines. Misconduct by a guest may result in the member’s privileges being suspended or revoked.

10. Facility Access and Security

A. Operating Hours
Hours of Operation: Our hours of operation are kept updated on our contact page at hivefitclub.com

B. Access Procedures
Entry Requirements: Members gain access via our Kisi door access system. In the event of lost or stolen access devices, please notify the front desk immediately to secure your account.

C. Security Measures
Monitoring: The facility is monitored by security cameras. While we take reasonable precautions, Hive Fit Club is not responsible for personal property losses.
Member Responsibility: Members are responsible for safeguarding their belongings while on the premises.

11. Dispute Resolution and Complaint Procedures

A. Resolution Process
Internal Resolution: If you have a complaint or concern, please contact our Member Services team at info@hivefitclub.com to seek an informal resolution.

B. Mediation/Arbitration
Arbitration Clause: If a dispute cannot be resolved informally, you agree that any claim or dispute arising out of or relating to these Terms will be resolved through mediation, and if necessary, binding arbitration administered by the American Arbitration Association (AAA) under its rules.
Location: Any arbitration proceedings will take place in Scottsdale, AZ unless otherwise mutually agreed.

12. Advertising, Promotions, and Social Media Guidelines

A. Use of Club Name/Logo
Guidelines: Members may not use Hive Fit Club’s name or logo in any promotional materials without prior written consent.

B. Member Testimonials & Media Release
Consent: By entering the premises or participating in any activities, you grant Hive Fit Club full, irrevocable, and royalty-free permission to photograph, film, livestream, or otherwise record your image, likeness, voice, name, and participation — and to use, reproduce, modify, display, distribute, license, and publish this content in any format and for any purpose whatsoever, including but not limited to commercial, promotional, and social media use, in perpetuity, with no compensation owed to you.

C. Social Media Conduct
Expectations: When discussing Hive Fit Club online, please maintain respectful and accurate communication. Do not post defamatory or misleading information that could harm the reputation of the club or its members.

13. Policy Amendments

A. Right to Amend
Hive Fit Club reserves the right to modify, update, or amend these Terms at any time.

B. Notification Process
Communication: Any changes to these Terms will be communicated via email and/or by posting on our website at least 30 days prior to implementation. Continued use of our services after notification constitutes acceptance of the revised Terms.

14. Special Considerations (e.g., COVID-19 or Other Health Crises)

A. Health Protocols
Additional Measures: During public health crises (such as COVID-19), Hive Fit Club may implement additional health and safety protocols including, but not limited to:

  • Mask mandates

  • Enhanced cleaning and sanitization procedures

  • Social distancing measures

B. Policy Adjustments
Government Directives: In response to public health guidelines or government directives, certain services, access hours, or policies may be updated. Members will be notified of such changes promptly.

15. Membership Pause Policy

  • Members must be active and paying for at least three (3) consecutive months before becoming eligible for a pause.

  • After that, a member may pause once per calendar year for a maximum of three (3) months.

  • Pause requests must be submitted in writing and approved by Hive Fit Club management.

  • During a pause, billing and access are both suspended.

  • Pause time cannot be split or carried over.

Acknowledgment and Agreement

By accessing Hive Fit Club’s facilities or services and by signing below, you acknowledge that you have read, understood, and agreed to these Membership Terms of Service, and that you have also signed the required Liability Waiver Agreement.
